Pickleball Tournament Waiver

KCSMW Pickleball Tournament Waiver, Release of Liability, and Consent

By registering for or participating in this tournament, I acknowledge, understand, and agree to the following on behalf of myself and, if applicable, on behalf of each participant I am registering:

1. Assumption of Risk
   
   I understand that participation in pickleball and related tournament activities involves inherent risks, including but not limited to falls, collisions, overexertion, dehydration, equipment-related incidents, and other risks that may result in personal injury, illness, disability, death, property damage, or property loss. I voluntarily accept and assume all such risks, whether known or unknown, associated with participation in the tournament and any related activities, including arrival, check-in, warm-up, play, and departure.
2. Fitness to Participate
   
   I confirm that each participant I register is physically able to participate safely in the tournament and has not been advised by a qualified medical professional not to participate. I understand that each participant is responsible for hydration, proper footwear, and using appropriate protective gear as desired.
3. Release and Waiver of Liability
   
   To the fullest extent permitted by applicable law, I, on behalf of myself and each participant I register, waive, release, and discharge KCSMW, its organizers, committee members, volunteers, referees, event staff, sponsors, venue owners/operators, and all related representatives from any and all claims, demands, causes of action, liabilities, damages, losses, costs, or expenses arising out of or related to participation in the tournament, including claims arising from personal injury, illness, death, theft, loss of property, or other damage, whether caused by negligence or otherwise, except to the extent prohibited by law.
4. Agreement Not to Sue and Indemnity
   
   I agree, on behalf of myself and each participant I register, not to sue any of the released parties for any matter arising from or related to participation in the tournament. I further agree to indemnify and hold harmless the released parties from claims, losses, damages, or expenses arising out of my acts, omissions, or breach of this agreement, including any claim that I was not authorized to accept this waiver on behalf of another participant.
5. Authorization to Register for Others
   
   If I am registering anyone other than myself, I represent and warrant that I am authorized to complete the registration and accept this waiver on that participant’s behalf.

 

For adult participants:

I confirm that I have obtained that participant’s permission and consent to register them and agree to this waiver on their behalf.

For minor participants:

I confirm that I am the parent or legal guardian of the minor, or I am registering the minor with the express authorization of the minor’s parent or legal guardian, and I agree to this waiver on the minor’s behalf.

I understand that KCSMW is relying on this authorization and representation as part of the registration process.

1. Rules, Conduct, and Eligibility
   
   I agree that each participant I register will follow all tournament rules, venue rules, safety instructions, and directions given by organizers, referees, volunteers, and facility staff. I understand that failure to follow rules, unsafe conduct, abusive behavior, false representation, or unsportsmanlike conduct may result in disqualification or removal from the event without refund.
2. Personal Responsibility
   
   I understand that participants are responsible for their own conduct, personal belongings, equipment, and timely arrival. I acknowledge that organizers may enforce event flow, court assignments, check-in requirements, and forfeiture rules as needed for tournament operations.
3. Medical Consent and Emergency Care
   
   In the event of an injury, illness, or medical emergency, I authorize event organizers to obtain basic first aid, emergency assistance, or medical treatment for the participant if deemed necessary. I understand that organizers are not obligated to provide medical care and that any related costs are the sole responsibility of the participant or the participant’s parent/legal guardian.
4. Photo and Video Release
   
   I grant permission to KCSMW and its representatives to photograph, record, or capture video/audio of participants during the event and to use such materials for community, promotional, archival, editorial, or social media purposes, without compensation or further approval. I waive any right to inspect or approve the final use of such materials.
5. Severability and Broad Interpretation
   
   If any provision of this waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. This waiver shall be interpreted as broadly as permitted by applicable law.

 

Acknowledgment

I confirm that I have read and understood this waiver. By proceeding with registration and selecting the acknowledgment checkbox, I agree to this waiver voluntarily and intend for it to be legally binding on myself and on each participant I am authorized to register.
