Sports Day Waiver

I acknowledge and accept all the risks associated with participating in the KCSMW-Kayikamela event. These risks may include, but are not limited to, those arising from negligence or carelessness by the individuals or entities being released, from faulty or hazardous equipment or property owned, maintained, or controlled by them, or due to their potential liability without fault.

I confirm that I am physically fit and have not been advised against participating by a qualified medical professional. I assure that there are no health issues or conditions that would prevent my participation in the Kayikamela. I understand that this Accident Waiver and Release of Liability Form will be used by the event organizers and will dictate my actions and responsibilities during the sports activity.

In consideration of my application and permission to participate in the Kayikamela, I, for myself, my executors, administrators, heirs, next of kin, successors, and assigns, agree to the following:

(A) WAIVE, RELEASE, AND DISCHARGE any and all liability, including but not limited to liability arising from the negligence or fault of the released parties, for my death, disability, personal injury, property damage, property theft, or any other harm that may occur to me, including travel to and from the activity.

(B) INDEMNIFY, HOLD HARMLESS, AND AGREE NOT TO SUE the entities or individuals mentioned in this waiver from any claims or liabilities resulting from my participation in the Kayikamela, whether caused by negligence or otherwise.

I acknowledge that participating in the Kayikamela may involve potential risks, including serious injury, death, and personal loss. These risks may arise from various factors such as terrain, facilities, weather conditions, participant health, equipment, traffic, and the actions of other people, including participants, volunteers, spectators, and coaches, as well as dehydration.

Team Captain or Parent/Guardian Registration
As the undersigned team captain, parent, or legal guardian, I confirm that I am authorized to act on behalf of all participants I register for the KCSMW Kayikamela. By signing this waiver, I represent and warrant that:

I have obtained consent from each team member or the parents/legal guardians of any minors for whom I am registering to participate in the KCSMW Kayikamela.
I agree that all team members or registered minors are subject to the terms and conditions outlined in this waiver.
I take full responsibility for communicating the terms of this waiver to each team member or parent/legal guardian and ensuring they understand and accept the risks involved.
I further agree to indemnify and hold harmless all parties referenced above from any liability, loss, cost, claim, or damage resulting from my lack of capacity to act on behalf of the minor and the parents or legal guardian.
I consent to allow representatives or volunteers to take photographs or digital recordings of me and any minors under my custody during this event and use them for promotional purposes. I also consent to the use of my identity in such photographs or recordings, with any associated description or commentary. I waive any rights or claims for financial or other compensation.

This accident waiver, release of liability, and image release shall be interpreted broadly to provide a release and waiver to the maximum extent permitted by applicable law.

I CERTIFY THAT I HAVE READ AND UNDERSTAND THIS DOCUMENT. I ACKNOWLEDGE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT, AND I SIGN IT VOLUNTARILY OF MY OWN FREE WILL.
